Terms and Conditions

 

1. Promoter: The promoter of this prize draw is BeActiv (“we” or “us”), a Melbourne-based startup in Victoria, Australia. You can reach us for any questions about this giveaway at contact@beactivapp.com.

2. Eligibility: This prize draw is open to individuals who complete the BeActiv Survey and are aged 18 years and older at the time of entry. Participants must be residents of Australia. Only one survey entry per person is allowed. Employees, volunteers, or affiliates of BeActiv (and their immediate family members) are not eligible to enter.

3. Entry Procedure: No purchase is necessary to enter. To enter the prize draw, an eligible participant must complete the online BeActiv Survey and provide the required contact information (such as a name and a valid email address). By filling out the survey you agree to these Terms & Conditions. Entering the prize draw is optional – if you would like to fill out the survey, but do not wish to participate in the draw, you may contact us to remove you. Only survey submissions completed within the promotion period (see below) with the necessary contact info (if entering the draw) will be included in the draw. Duplicate entries or multiple survey submissions by the same person will be disqualified.

4. Promotion Period: The prize draw entry period runs from the survey launch date up to 11:59 PM on Sunday November 30th (AEST). Entries received after this deadline will not be eligible. BeActiv reserves the right to extend or shorten the entry period if necessary, but will announce any change publicly (for example, on our website or social media).

5. Prize Description: The prize is one (1) Black Apple iPhone 13 256gb smartphone in used but excellent condition. Please note: this device is pre-owned (not brand new) but has been verified to be in perfect working condition. No manufacturer’s warranty is provided with this iPhone 13. The prize is provided “as is,” without any express or implied warranty. By accepting the prize, the winner acknowledges that it is a used item and agrees that BeActiv has no further obligation regarding any maintenance or defects. The prize is not transferable or exchangeable and cannot be redeemed for cash or any alternative. (If for any reason the specified prize becomes unavailable, BeActiv reserves the right to substitute it with an item of equal or greater value at its discretion.)

6. Draw and Winner Selection: Within 14 days after the entry period closes, one (1) winner will be selected at random from all eligible entries. The draw will be performed fairly, such as by using a random computer process or drawing names from a pool, under the supervision of the BeActiv team. Each entry has an equal chance of winning. The odds of winning depend on the total number of eligible entries received.

7. Winner Notification: The winner will be notified via the contact details they provided (likely by email, or by phone if that was given) within 5 business days of the draw. We will send an email (or make a phone call/text) to the winner with instructions on how to claim the prize. It is important that entrants provide a valid email address (and ensure they check it after the draw date). If the winner does not respond and confirm acceptance of the prize within 7 days of our first notification attempt, or if the provided contact information is invalid/unreachable, BeActiv reserves the right to deem that winner ineligible. In such case, we may conduct a redraw to select an alternate winner from the remaining eligible entries (who will then be notified in the same manner).

8. Prize Delivery: Once the winner is confirmed, we will arrange delivery of the iPhone 13 prize at no cost to the winner. Delivery will be coordinated directly with the winner — the device can be shipped to the winner’s provided postal address (with appropriate packaging and tracking) or alternatively handed over in person if practical (for example, if the winner is local and prefers an in-person handover). BeActiv will cover standard shipping costs within Australia. We will make reasonable efforts to ensure the prize is delivered safely; however, the winner assumes responsibility for the prize once it has been delivered. BeActiv is not liable for any loss or damage to the prize after it has been delivered to the winner.

9. Privacy and Consent: Personal information collected as part of the survey and prize draw (such as your name and contact details) will be used only for the purposes of administering this promotion, contacting the winner, and as otherwise set out in our privacy statement above. We value your privacy – if you opted into our mailing list, we will use your email to send you updates as described, but if you did not opt in, your contact information will not be used for any marketing or added to any mailing lists. We will not disclose your personal information to third parties except as required to deliver the prize or by law. By entering the prize draw, you consent to our collection and use of your personal data for these purposes. 10. General Conditions: By participating in this prize draw, you indicate that you accept these Terms & Conditions. Entries that do not comply with these terms (for example, incomplete surveys, false information, or multiple survey entries from one person) may be deemed invalid. BeActiv reserves the right to verify the eligibility of entrants and the validity of entries at any time. If there is any dispute regarding the conduct of the competition or the claiming of the prize, BeActiv’s decision will be final. We reserve the right to cancel, modify, or suspend the prize draw if an unexpected factor outside our control interferes with its fairness or proper conduct (for instance, if there are technical issues with the survey platform or insufficient responses), subject to any necessary regulatory approval. In the event of cancellation, we will notify participants via the contact information provided or public announcement.

    This giveaway is in no way sponsored or endorsed by Apple, Google, or any other company. Apple is not affiliated with this contest – the use of an iPhone as a prize is solely the choice of BeActiv. By entering, participants release Apple and Google (the platform hosting the survey) from any liability related to the contest. Participants also agree that BeActiv will not be liable for any injury, loss, or damage of any kind arising from or in connection with the prize draw or the use of the prize, except for any liability that cannot be excluded by law.
